The advent of formal definitions of the simplicity of a theory has important implications for model selection. But what is the best way to define simplicity? Forster and Sober ([1994]) advocate the use of Akaike's Information Criterion (AIC), a non-Bayesian formalisation of the notion of simplicity. This forms an important part of their wider attack on Bayesianism in the philosophy of science. We defend a Bayesian alternative: the simplicity of a theory is to be characterised in terms of Wallace's Minimum (...) Message Length (MML). We show that AIC is inadequate for many statistical problems where MML performs well. Whereas MML is always defined, AIC can be undefined. Whereas MML is not known ever to be statistically inconsistent, AIC can be. Even when defined and consistent, AIC performs worse than MML on small sample sizes. MML is statistically invariant under 1-to-1 re-parametrisation, thus avoiding a common criticism of Bayesian approaches. We also show that MML provides answers to many of Forster's objections to Bayesianism. Hence an important part of the attack on Bayesianism fails. (shrink)

Patients have received experimental pharmaceuticals outside of clinical trials for decades. There are no industry-wide best practices, and many companies that have granted compassionate use, or ‘preapproval’, access to their investigational products have done so without fanfare and without divulging the process or grounds on which decisions were made. The number of compassionate use requests has increased over time. Driving the demand are new treatments for serious unmet medical needs; patient advocacy groups pressing for access to emerging treatments; internet platforms (...) enabling broad awareness of compelling cases or novel drugs and a lack of trust among some that the pharmaceutical industry and/or the FDA have patients’ best interests in mind. High-profile cases in the media have highlighted the gap between patient expectations for compassionate use and company utilisation of fair processes to adjudicate requests. With many pharmaceutical manufacturers, patient groups, healthcare providers and policy analysts unhappy with the inequities of the status quo, fairer and more ethical management of compassionate use requests was needed. This paper reports on a novel collaboration between a pharmaceutical company and an academic medical ethics department that led to the formation of the Compassionate Use Advisory Committee. Comprising medical experts, bioethicists and patient representatives, CompAC established an ethical framework for the allocation of a scarce investigational oncology agent to single patients requesting non-trial access. This is the first account of how the committee was formed and how it built an ethical framework and put it into practice. (shrink)

James McAllister’s 2003 article, “Algorithmic randomness in empirical data” claims that empirical data sets are algorithmically random, and hence incompressible. We show that this claim is mistaken. We present theoretical arguments and empirical evidence for compressibility, and discuss the matter in the framework of Minimum Message Length (MML) inference, which shows that the theory which best compresses the data is the one with highest posterior probability, and the best explanation of the data.

The gut protozoan parasite, Giardia duodenalis, is the best characterized example of the most ancient eukaryotes, which are anaerobic and appear to be primitively amitochondrial. Apart from its obvious medical importance, Giardia is fascinating in its own right. Its prokaryotic-like anaerobic metabolism renders it selectively sensitive to some bacterial drugs, especially the nitroimidazoles, which are activated to form toxic radicals. Other features, including an enzyme that reduces oxygen directly to water, cysteine as the keeper of redox balance, a plasmid, and (...) toxin-like genes are also distinctly prokaryotic-like. But, unlike prokaryotes, Giardia has a sophisticated, highly developed cytoskeleton, bounded nuclei, linear chromosomes capped with telomeric repeats, and telomere positional regulation of gene expression. The Strange Situation procedure was developed by Ainsworth two decades agoas a means of assessing the security of infant-parent attachment. Users of the procedureclaim that it provides a way of determining whether the infant has developed species-appropriate adaptive behavior as a result of rearing in an evolutionary appropriate context, characterized by a sensitively responsive parent. Only when the parent behaves in the sensitive, species-appropriate fashion is the baby said to behave in the adaptive or secure fashion. Furthermore, when infants are (...) observed repeatedly in the Strange Situation,the pattern of behavior is said to be highly similar, and this pattern is said to predict the infants' future behavior in a diverse array of contexts. After an exhaustive review of the literature, it is shown that these popular claims are empirically unsupported in their strong form, and that the interpretations in terms of biological adaptationare misguided. There is little reliable evidence about the specific dimensions of parental behavior that affect Strange Situation behavior, although there does appear to be some relationship between these constructs. Temporal stability in security of attachment ishigh only when there is stability in family and caretaking circumstances. Likewise, patterns of Strange Situation behavior only have substantial predictive validity in similarly stable families. Implications for future research and theorizing — particularly as they relate to the use of evolutionary biology in psychological theory — are discussed. (shrink)

Si la phénoménologie a pour principe fondamental d?exprimer la chose même, son objet ne peut être le phénomène mais la phénoménalité, à savoir la façon dont les phénomènes se montrent à nous, c?est-à-dire leur apparaître et ce, parce que c?est précisément cette phénoménalité qui nous livre accès aux phénomènes. Par conséquent la méthode phénoménologique doit en tout point coïncider avec la phénoménalité en tant que c?est elle qui opère la révélation : « L?objet de la phénoménologie constitue identiquement sa méthode (...) et son langage » 1 . Cela conduit Henry à souligner un premier problème inhérent à la démarche phénoménologique : la méthode phénomé­nologique, et le projet qu?elle entreprend de dévoiler la chose même, pré­suppose déjà, comme sa propre possibilité « cette illumination première hors de laquelle aucune chose n?existe » 2 . En ce sens nous ne pouvons définir la méthode phénoménologique comme originelle puisque l?objet dévoilé par elle n?est autre que sa possibilité. Voilà en quoi la réduction est d?ores et déjà falsifiée puisque l?apparaître auquel elle ouvre n?est autre que sa condition propre déjà présupposée. Autrement dit, ce que la phénoménologie nous donne juste­ment, c?est la condition de son faire voir et rien d?autre. J?aimerais interroger ici le problème de la négation de la vie à partir de certains textes de Michel Henry consacrés à Friedrich Nietzsche dans Généalogie de la psychanalyse . Par négation de la vie, Michel Henry désigne l?ensemble des modes de vie que nous pouvons ramener sous le projet de rompre avec la vie. Il emprunte à Friedrich Nietzsche des exemples tels que le doute à l?égard de soi, l?objectivisme, le scientisme, la critique de soi, la mauvaise conscience et une (...) figure devenue l?archétype de la négation, celle du prêtre. Le prêtre est l?homme qui tourne le dos à la vie, qui l?infirme et qui la nie pour aspirer à un au-delà, un ailleurs, une autre vie. Naïvement, le problème de la négation se formule de la manière suivante : l?individu peut-il se tourner contre la vie et la nier ? Pour répondre à cette première question, il me faut reprendre sommairement les principaux aspects de l?articulation de la vie et de la conscience telle qu?elle ressort des analyses des textes de Nietzsche par Michel Henry. Premièrement, la conceptualisation henryenne de l?articulation de la vie et de la conscience repose sur une idée fondamentale : « La vie, en tant que se supportant soi-même », en tant que s?éprouvant soi-même dans tout ce que l?individu est amené à vivre est un « a priori insupportable 1 . » Dans Du communisme au capitalisme , Henry revient sur cet être-rivé à soi de la vie : pure présence à. Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. Cet ouvrage est issu d’un colloque qui s’est déroulé à Paris (au Sénat) en janvier 2008. Il a été dirigé par les professeurs Gilles Darcy et Mathieu Doat, avec le soutien du Centre de Recherches Administratives de l’université de Brest et le Centre d’étude et de Recherches Administratives et Politiques de l’université de Paris 13 (Paris-Nord). Cet ouvrage cherche à mieux saisir les relations complexes entre le droit et l’imaginaire. En effet, le droit moderne est tout entier placé sous le (...) signe de la raison. L’imaginaire en semble exclu. Il est abandonné à l’art, aux poètes et aux peintres. L’image est suspecte. Elle est fiction ou rêverie. Aujourd’hui, le dépassement sinon la fin de l’ère moderne, par l’inflation des normes, la flexibilité des règles, la complexité des systèmes juridiques ont sous nos yeux des conséquences sur la manière dont on se représente le droit. Cette transformation du droit oblige à tâtonner parfois, à imaginer aussi, voire à rêver de nouvelles formes juridiques. Elle révèle en fait la part toujours présente de l’imaginaire dans le droit. C’est cette place et cette fonction de l’imaginaire en droit que cet ouvrage collectif interroge à travers quatre questions très générales qui constitueront les parties du livre. Quelle est l’importance de la manipulation des images en droit? La pensée juridique classique a pour constante tradition de dévaluer l’image. Pourtant, l’image est partout. Elle sert notre représentation de la justice ; elle permet de rêver un droit meilleur. Se faisant séductrice, elle infiltre la plupart des concepts juridiques, cachant parfois l’idéologie. L’importance de la manipulation n’inquiète pas toujours. Elle est cependant présente. Quelle part l’imagination et la rêverie prennent-elles dans la production du droit et du savoir juridique? L’imagination permet la création, l’invention des normes, des solutions juridiques et des théories. Elle déforme aussi les idées. Elle inspire le juge et transforme les textes. Comment l’imaginaire sert-il à fonder la puissance et la magie du droit? C’est la force et la puissance de l’image et de ses montages qu’il faut essayer ici de saisir. L’imaginaire fonde, bâtit, justifie, motive, légitime le système juridique. Qu’est-ce que connaître le droit quand il n’y a de connaissance que dans l’espace de la fiction? Le droit ne peut se passer de l’imaginaire. C’est une toile d’araignée qui met en rapport des mots. How do laws resemble rules of games, moral rules, personal rules, rules found in religious teachings, school rules, and so on? Are laws rules at all? Are they all made by human beings? And if so how should we go about interpreting them? How are they organized into systems, and what does it mean for these systems to have 'constitutions'? Should everyone want to live under a system of law? Is there a special kind of 'legal justice'? Does it consist (...) simply in applying the law of the system? And how does it relate to the ideal of 'the rule of law'?These and other classic questions in the philosophy of law form the subject-matter of Law as a Leap of Faith. In this book John Gardner collects, revisits, and supplements fifteen years of celebrated writings on general questions about law and legal systems - writings in which he attempts, without loss of philosophical finesse or insight, to cut through some of the technicalities with which the subject has become encrusted in the late twentieth century. Taking his agenda broadly from H.L.A. Hart's The Concept of Law, Gardner shows how the key ideas in that work live on, and how they have been and can still be improved in modest ways to meet important criticisms - in some cases by concession, in some cases by circumvention, and in some cases by restatement. In the process Gardner engages with key ideas of other modern giants of the subject including Kelsen, Holmes, Raz, and Dworkin. In this paper I outline various different objects of investigation that may be picked out by word “law” (or its cognates). All of these objects must be investigated in an integrated way before one can provide a complete philosophical explanation of the nature of law. I begin with the distinction between laws (artefacts) and law (the genre to which the artefacts belong). This leads me to the distinction between the law (of a particular legal system) and law (the genre of (...) artefacts). Then I discuss the contrast between law (the genre of artefacts) and law (the practice). Finally I comment on legality as the name of an ideal for laws and legal systems to live up to. I commend H. L. A. Hart's explanation of the nature of law for investigating these various objects in an integraed way, while nevertheless respecting the distinctions among them. I also criticise some of R. M. Dworkin's work for failing to respect the same distinctions. (shrink)

Psychologue cognitiviste américain de renommée internationale Howard Gardner mène, depuis trente ans, des recherches sur l'intelligence qui renouvellent l'approche traditionnelle de la question. Il montre en particulier que le test du Q.I., largement utilisé, en France notamment, pour déterminer les aptitudes des individus, n'explore en fait qu'un seul type d'intelligence. Résumant dans ce livre ses recherches antérieures, Gardner explique qu'il existe en réalité sept formes d'intelligence qui recouvrent dans leurs nuances l'ensemble des capacités humaines : l'intelligence verbale, logico-mathématique, (...) spatiale, musicale, corporelle et kinesthésique, interpersonnelle (intelligence des autres) et intrapersonnelle (intelligence de soi). Or seules les intelligences verbale et logico-mathématique sont traditionnellement prises en compte et développées à l'école. L'approche de Gardner permet donc de comprendre un grand nombre des difficultés que rencontrent aujourd'hui le système éducatif et, plus largement, nos sociétés tout entières. Elle annonce aussi la nécessaire mutation de l'école qui doit repenser ses modèles d'apprentissage pour permettre à chacun de développer son potentiel d'intelligence selon une large gamme d'aptitudes. Ce livre passe en revue des situations de terrain variées et permet d'aborder sous un angle concret la théorie novatrice des intelligences multiples. (shrink)

The idea of a 'logic of quantum mechanics' or quantum logic was originally suggested by Birkhoff and von Neumann in their pioneering paper [1936]. Since that time there has been much argument about whether, or in what sense, quantum 'logic' can be actually considered a true logic (see, e.g. Bell and Hallett [1982], Dummett [1976], Gardner [1971]) and, if so, how it is to be distinguished from classical logic. In this paper I put forward a simple and natural semantical (...) framework for quantum logic which reveals its difference from classical logic in a strikingly intuitive way, viz. through the fact that quantum logic admits (suitably formulated versions of) the characteristic quantum-mechanical notions of superposition and incompatibility of attributes. That is, precisely the features that distinguish quantum from classical physics also serve, within this framework, to distinguish quantum from classical logic. Some light is shed on the question of whether quantum logic is a genuine logical system by introducing a natural entailment relation for quantum-logical formulas with the implication symbol. The novelty is that, although implication behaves as it should (i.e. the 'deduction theorem' holds), the order of introduction of premises is significant. The fact that a reasonable entailment relation can be formulated for quantum logic supports the view that it is a genuine logical system and not merely an algebraic formalism. (shrink)

Unavailable for ten years, this new edition reproduces the original text, adding a new critical introduction by John Gardner, a leading contemporary criminal law theorist.

In his book, Five Minds for the Future, Howard Gardner offers both a constructive critique of current educational practices and an alternative vision for the future of education. Gardner, best known for his seminal work on multiple intelligences, grounds his major conclusions primarily on the results of his impressive, decade-long, and massive Good Works Project. Despite my several agreements and significant overlap with Howard Gardner, I believe that there is insufficient evidence to accept fully his policy prescriptions. (...) Gardner's selection of the five minds of the future - the disciplined, synthesizing, creating, respectful, and ethical minds - is based on a set of limiting assumptions concerning globalization, good work, individuality, power and control, disciplines as value-free enterprises, ethics as the point of view of the universe, and the completeness of his list. This paper suggests that our conception of education might be dramatically expanded to include a more critical and distanced stance towards: globalization, the current goals of business, individualism, the traditional disciplines, and even ethics than Gardner currently imagines. Its aims can and should be broadened to include not only good work, but also love and play. Students must learn how to control their environments, but also how to appreciate and accept life's inevitable difficulties and limits. Ethics should certainly play a more central role in education as Gardner correctly emphasizes, but our understanding of ethics must include not only respect but also care; not only principles but also dialog. To accomplish all of this, however, requires us to think beyond Gardner's five minds to include additional "mental dispositions" like the caring, critical, intersubjective, spiritual, and joyful minds.
